- The signing of the booking form shall indicate that the person signing is willing to enter into a legally binding contract
under English Law conferring rights and responsibilities on both parties.
- Bookings are only accepted from traders / exhibitors who are on the DME Ltd Approved Trader List.
- A contract shall not be formed until DME Ltd has confirmed, in writing (including electronically), that the booking has been
accepted. The contract shall be between DME Ltd and the individual signing the booking form.
- Any trader/exhibitor/craftsperson/artist/producer booking space at a Deborah Martyn event MUST have public liability insurance
sufficient to cover any reasonably foreseeable circumstance. Anyone booking a space at such an event without this insurance will
be refused permission to trade at the event and will not be eligible for a refund. Proof of cover MUST be sent when booking the
first event.
- Food traders / producers are responsible for ensuring that their production and preparation methods meet current legislation
guidelines and that they carry appropriate Health and Safety certificates and that anyone handling food at their stall has
appropriate Food and Hygiene training and certification. If hot food/drink is being offered for sale, the trader must ensure that
any cooking/heating equipment is safe and that any gas equipment is checked and certificated. Public safety takes priority over
any commercial consideration.
- The full cost of the first booking plus appropriate deposits must be paid when the booking form is returned. Each event is to
be paid for in advance and invoices will be issued for subsequent events booked by the trader. These invoices must be settled
before the end of the event at which they are issued. Christmas Street Markets - all events must be paid for in full, in advance.
- Cheques are to be made payable to "DEBORAH MARTYN EVENTS LIMITED." In the result of there being too many applications for
the space available cheques will be returned to unsuccessful applicants as quickly as possible. No interest will be paid.
- All goods and products sold by traders must be legal and comply with all current English and European safety and consumer
protection legislation. Goods should not be of a sexual or libidinous nature nor should they cause offence.
- All traders agree to behave in a courteous and professional manner in their dealings with each other, the public and any
representatives of DME Ltd.
- Any trader who is considered to be under the influence of drugs or alcohol, who is abusive or troublesome or who behaves in a
manner that may bring the event into disrepute will be instructed to leave the event with no possibility of a refund. Such a
trader will not be invited to any future events.
- DME Ltd have a strict NO SMOKING policy in the event hall.
- If any trader requires special access or equipment because of any disability or impairment then this must be made known to
DME Ltd prior to the event. The Organiser does not knowingly organise events in venues that are not accessible by the disabled.
- Traders will be expected to stay for the full duration of the event. It is courteous to other traders not to start packing
up until the time notified to you by your DME Ltd representative. Any trader who leaves before the event has ended, without
the permission of a DME Ltd representative, will be removed from the Approved Trader List.
- Overnight security is provided for all multi-day events. Security guard/s are on site to ensure that the venue remains as
safe and as secure as possible and to act as a deterrent to the casual thief. They are not there to look after individual
stalls; this is the sole responsibility of the stallholder.
- Stallholders must be at their stalls at least 30 minutes before the event opens and are required to remain at their stalls
until the event has closed and all members of the general public have left the area. No liability for loss or damage to goods
will be accepted by DME should a trader leave their stall before the circumstances described above.
- Should a trader cancel his or her booking/s, the following policy shall apply:
a). No refund shall be due if a cancellation is made (whichever is the soonest):
i). Within 4 weeks of the event date or
ii). After the event has been advertised as 'Sold Out' on the DME website.
b). For cancellations not covered by sub-para (i) or (ii) above, refunds shall be made only when the space has been re-sold,
otherwise no refund. DME Ltd may, at their discretion, transfer payments to the next booking by the cancelling trader.
c). If a trader cancels a booking for which only a deposit has been paid, and the cancellation falls within the timescale
described in ai) and aii) above, the outstanding balance must be paid by the trader. Failure to do will result in the
trader being removed from the 'Approved Trader' list.
d). All deposits are non refundable. DME Ltd may, at their discretion, transfer deposits to the next booking by the
cancelling trader.
- DME Ltd reserves the right to refuse a trader´s application or to cancel a booking. No reason need be given.
- Should DME Ltd, prior to an event (not including Christmas Street Markets- see below), cancel an event or a booking, full
refunds will be given unless circumstances fall into any of the categories described above. In the event of cancellation, no
liability will be accepted for extra costs incurred or sales lost. After an event has started, should circumstances (adverse
weather, fire, flood etc) cause the event to be abandoned or closed prematurely, refunds will only be made at the discretion
of the organiser.
- Christmas Street Markets: Because of the nature of these events, whereby road closures, policing, security and infrastructure
needs to be arranged considerably in advance, it is not possible for cancellation refunds to be given, whatever the circumstances.
This includes where the organiser decides that the event needs to be cancelled or abandoned in the interests of safety (eg bad
weather, fire, civil disturbance etc). Traders therefore make bookings for Christmas Street Markets on the understanding that
they are at their own risk and that no refunds will be due.
- If a trader has a complaint at an event of a matter that is within the remit of DME Ltd then he/she must inform the representative
immediately. The representative will do everything reasonably possible to resolve the complaint. Should the trader remain unsatisfied
then the complaint should be put in writing and sent to the address below. The Managing Director of DME Ltd undertakes to investigate
the complaint and respond, in writing, within seven working days to the complainant. The Managing Director's decision is final.
- Fairs and exhibitions should be fun, as well as an opportunity for traders to make money and so DME Ltd hopes that all traders
will enter into each event with courtesy, understanding and a positive attitude. For its part, DME Ltd will endeavour to make the
experience a pleasant one for traders and public alike.
